…under the new Construction Products Regulation, European Assessment Documents (EADs) and European Technical Assessments (ETAs) now have an expiry date?

With the entry into force of the new Construction Products Regulation (Regulation (EU) 2024/3110), after publication in the Official Journal of the European Union (OJEU), an EAD can be used as the basis for an ETA for a period of 10 years, unless the EAD reference has been removed from the OJEU or the EAD has been replaced by a harmonised technical specification. The TAO organization may, in the last year of this period, decide to propose the renewal of the EAD. In this case, the Commission re-evaluates the EAD and, if the document complies with the applicable legal requirements, the Commission publishes a reference to that document in the OJEU without delay.

In turn, ETAs issued based on an EAD remain valid for 5 years after the end of the established validity period of the EAD (10 years), or for 5 years after the reference to the EAD has been removed from the OJEU.

If the product becomes covered by a harmonized technical specification, the EAD can no longer be used for the purposes of Regulation (EU) 2024/3110 and that product can no longer be placed on the market based on an ETA.

Products covered by an EAD for which a European technical assessment has been issued may bear the CE marking, thus obtaining the same status as products with the CE marking based on harmonized technical specifications, provided that the manufacturer complies with the duties established in Regulation (EU) 2024/3110.
